This website is operated by Uptown Eye Specialists Inc., which carries on business as U Shoppe (“U Shoppe”, “we”, “us”). By accessing and shopping on ushoppe.ca, you agree to these Terms of Service. If you do not agree, please do not use this website.

1. Use of Website
A. License Grant
U Shoppe grants you a limited, non-exclusive license to access and use this website for lawful shopping purposes only. You may not: – Reproduce, modify, or distribute website content – Use automated bots or scrapers to collect data – Attempt to access restricted areas or bypass security – Engage in illegal activity or violate applicable laws
B. Account Responsibility
If you create an account: – You are responsible for maintaining account confidentiality – You are liable for all activity under your account – You agree to provide accurate information – You will not share your login credentials with others
C. Acceptable Use
You agree not to use U Shoppe to: – Post defamatory, abusive, or threatening content – Spam, harass, or impersonate others – Distribute viruses, malware, or harmful code – Engage in illegal activity – Violate intellectual property rights
2. Products and Pricing
A. Product Descriptions
We make every effort to describe products accurately. However, product images and descriptions are provided “as is.” Slight variations in appearance, colour, or packaging may occur due to photography, monitor settings, or manufacturer updates.
B. Pricing
All prices are displayed in Canadian dollars (CAD) and include product cost only. Ontario HST (13%) is calculated and displayed at checkout.
- Price changes: We reserve the right to change prices at any time. Price changes apply only to new orders, not orders already processed.
- Price errors: If a product is listed at an incorrect price due to a clerical error, we may cancel the order and refund you without liability.
- Sales and promotions: Promotional pricing is valid for the stated period only. We reserve the right to limit quantities per customer.
C. Product Availability
While we strive to keep inventory current, products may become unavailable. If a product you’ve ordered is out of stock, we will: 1. Contact you within 24 hours 2. Offer an alternative product at the same price, OR 3. Process a full refund
D. Third-Party Products
Some products may be sourced from manufacturers or distributors. We are not liable for defects in manufacturing or packaging.
3. Orders and Fulfillment
A. Order Acceptance
Placing an order constitutes an offer to purchase. U Shoppe reserves the right to: – Accept or decline any order – Cancel orders that appear fraudulent or violate these terms – Limit quantities per customer – Correct pricing errors before shipping
B. Order Confirmation
Order confirmation emails are automated confirmations of your purchase request, not confirmation of fulfillment. We’ll send a separate shipping notification once your order ships.
C. Shipping and Delivery
- Shipping times: Estimates provided at checkout are approximate and not guaranteed
- Risk of loss: Once shipped, products are at your risk. We recommend insurance for high-value orders
- Delivery: Carriers (Canada Post, Purolator, etc.) are responsible for final delivery. We are not liable for carrier delays
- Refused delivery: If you refuse delivery, you are responsible for return shipping costs
D. International Shipping
U Shoppe currently ships within Canada only. We do not ship internationally at this time.
4. Payment
A. Payment Methods
We accept credit cards (Visa, Mastercard, American Express) and other payment methods via Square. All payments are processed securely.
B. Card Authorization
By providing your card information, you authorize us to charge your card for the full order amount, including applicable taxes and shipping.
C. Billing Address
Your billing address must match your card issuer’s records. We are not liable for declined transactions due to mismatched addresses.
D. Fraudulent Transactions
If you notice unauthorized charges, contact us immediately. We will investigate and assist with chargeback claims if necessary.
5. Refunds and Returns
Unopened product may be returned within 30 days of the delivery date, in the condition you received it and with proof of purchase. For complete refund and return details, see our Shipping & Returns Policy.
A. Refund Timeline
- Refunds are processed within 5 business days of receiving returned items
- Funds appear in your account within 5–10 business days depending on your financial institution
- Refunds are issued to the original payment method
B. Non-Returnable Items
The following items cannot be returned for sanitary or safety reasons: – Contact lens solutions (opened or used) – Eyedrops or lubricants (opened or used) – Heating pads or masks (used) – Supplements (opened or used)
C. Return Shipping
Return shipping is at your cost. You may return by mail to the address in section 17, or in person at any of our locations. We recommend using a tracked service — we cannot be responsible for items lost or damaged on their way back to us.
D. Refund Exceptions
We are not liable for: – Original shipping charges, which are not refunded – Lost or damaged returns (use tracking) – Custom or special-order products (once shipped)
6. Warranties and Disclaimers
A. Warranties
We do not make any express warranty of our own beyond the manufacturer’s warranty supplied with a product. Consult the product page and the manufacturer’s information for the terms of any such warranty.
This section does not negate or vary the implied conditions and warranties that apply to goods under Ontario law. Those are preserved in section 7A, and they apply whatever else these terms say.
B. What We Cannot Tell You
Our product pages give general information. We cannot advise on:
- Whether a product is suitable for your particular condition — consult your eye care provider
- How a product will interact with your medications or other products
- What result or outcome you should expect from using a product
Always check expiry dates before use.
C. Manufacturer Warranties
Some products include manufacturer warranties. These are separate from our return policy and are governed by the manufacturer.
7. Limitation of Liability
A. Disclaimer
To the fullest extent permitted by law, we are not liable for:
- Indirect, incidental, consequential or punitive damages
- Lost revenue, lost profits or business interruption
- Loss or damage arising from use of a product contrary to its labelling, its instructions, or the advice of your eye care provider
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded by law. Nothing in these terms affects your rights under Ontario’s Consumer Protection Act, 2002 or the conditions and warranties implied by the Sale of Goods Act (Ontario).
B. Liability Cap
Subject to the paragraph above, our total liability to you for any claim relating to a product or an order is limited to the amount you paid for that product.
C. Health Disclaimers
- Products sold on U Shoppe are not intended to diagnose, treat, cure, or prevent disease
- Products are not replacements for professional medical care
- Always consult your eye care provider before using new products, especially if you have a medical condition
- Immediately discontinue use if you experience adverse effects and seek medical attention
8. Intellectual Property
A. Copyright
All website content (text, images, graphics, logos, designs) is owned by, or licensed to, Uptown Eye Specialists Inc. and the U Vision Group family of companies. You may not: – Reproduce or distribute website content – Modify, adapt, or create derivative works – Use content for commercial purposes – Remove copyright or ownership notices
B. Trademarks
“U Shoppe,” “U Vision Group,” and related logos are trade marks and brand names of the U Vision Group family of companies, used by Uptown Eye Specialists Inc. in operating U Shoppe. Unauthorized use is prohibited.
C. Third-Party Content
Product descriptions, brand logos, and manufacturer information are used with permission or fair use. We do not claim ownership of these materials.
9. Third-Party Links and Content
U Shoppe may link to: – UVG clinical websites (Uptown Eye, UELC, UDEI, U Optical, U Surgical Centre, FORSEE Canada) – Product manufacturer pages – Clinical research or educational resources
We are not responsible for: – Content on third-party websites – Third-party privacy practices or terms of service – Broken links or outdated information – Products or services offered by third parties
10. User-Generated Content
If you submit reviews, feedback, or photos: – You grant U Shoppe a non-exclusive license to use, modify, and publish this content – You represent that you own the content and have the right to grant this license – We may remove content that violates these terms or our Privacy Policy – You are responsible for the accuracy and legality of your submissions
11. Prohibited Activities
You agree not to use U Shoppe for: – Illegal activities or fraud – Hacking, phishing, or unauthorized access – Harassment, defamation, or abuse – Copyright infringement – Spam or unsolicited communications – Reselling products without authorization
Violation of these terms may result in account suspension or legal action.
12. Modifications to Terms
We may update these Terms of Service from time to time. The date at the top of this page shows when they were last changed, and the version published here is the one that applies. The terms that govern your order are the ones in effect when you place it — a later change does not alter an order you have already placed. If we make a change that materially affects your rights, we will say so on this page.
13. Governing Law and Jurisdiction
These Terms of Service are governed by the laws of Ontario, Canada. You agree to submit to the exclusive jurisdiction of Ontario courts for any disputes.
14. Dispute Resolution
A. Informal Resolution
Before pursuing legal action, we encourage you to contact us to resolve disputes informally.

B. If we cannot resolve it
If a dispute is not resolved informally, you and we may agree to mediation or arbitration. Nothing in these terms requires you to arbitrate, and nothing in them limits your right to bring a claim in the courts of Ontario — including any right you have under Ontario’s Consumer Protection Act, 2002 to commence an action in the Superior Court of Justice, or to take part in a class proceeding.
15. Severability
If any provision of these terms is found invalid or unenforceable, that provision is severed and the remaining terms remain in effect.
16. Entire Agreement
These Terms of Service, together with our Privacy Policy and Shipping & Returns Policy, constitute the entire agreement between you and U Shoppe. Previous agreements or understandings are superseded.
